Robbery
1st Degree Armed Robbery: State v. D.A. (Union County) Client was charged with three armed robberies. Investigation revealed that one victim was communicating with him and owed him money. She gave him her phone and told her mother it was stolen in a robbery. Video from a nearby High School also corroborated our client’s version. Video from a gas station revealed the second victims were less than truthful and text records also showed that a robbery did not take place. The third robbery was reduced after Motion to remove the knife from the case was granted. Three robberies dismissed, one theft left.
Burglary
All felony charges are heard by the Superior Court. New Jersey has four felony levels. Fourth degree felonies carry up to 18 month in state prison and $10,000 in fines. Examples are small amount Marijuana distribution, credit card theft, theft over $200 and possession of a knife. Third degree felonies have a 3 to 5 year state prison range and $15000 in fines. The fines for third degree drug charges are higher. Examples are possession of drugs not marijuana, burglary, aggravated assault with significant injury and theft over $500. First time 4th and 3rd degree offenses carry a presumption against state prison but may receive up to 364 days in the county jail as a condition of probation.

In New Jersey, shoplifting can be a minor offense resulting in a disorderly person charge, to a serious, indictable crime that carries years in prison if convicted. In general, if the value of the merchandise stolen is less than $200, you will be charged with a disorderly person offense. If the value of the merchandise is between $200 and $500, you will be charged with a fourth-degree, indictable offense. Shoplifting involving merchandise between $500 and $75,000, is a third-degree, indictable offense. Shoplifting involving merchandise over $75,000 is a second-degree offense involving jail time, if convicted.

Client conducted a search for their child and discovered her at a school. Client follow the school bus to obtain the address of the mother. Client was charged with stalking and attempted Kidnapping. Our investigation established ex-wife took their child in violation of foreign court order. Witnesses were provided to the State that contradicted the wife’s version of events. Grand Jury no-billed.
Manslaughter
Second degree offenses have a 5 to 10 year state prison range and $150,000 in fines. Examples are robbery without a weapon, possession of a handgun, theft over $75,000, eluding police, aggravated assault with serious injury, drug distribution over 14 grams, school zone cases, and sexual assaults. Drug offenses carry higher fines. First degree offenses have a 10 to 20 year prison range and $200,000 in fines. Examples are manslaughter, certain arsons, attempted murder, and drug sales over 5 ounces. Again drug charges carry higher fines. Murder, Kidnapping and Rico charges are also first degrees offenses but have 30 to life sentences. 1st and 2nd degree charges carry a presumption of state prison. Also all crimes of violence carry an 85% parole ineligibility.

Property Damage
The penalties for leaving the scene of an accident (hit-and-run) in the state of New Jersey are very serious if an injury or fatality is involved.
