But my broader point is, this sort of thing needs to be thought about, talked about, prior to the marriage. And each person’s answer may be very different; as I’ve noted, not everyone thinks they owe anything to their children; and if someone doesn’t have children they may have a very different attitude towards this than someone who does have children. And, you should realize, notwithstanding a prenuptial agreement, if you give something to your new spouse, it becomes theirs. If you add their name to a deed, they now own half the property; if you put their name on an investment account or a Certificate of Deposit, they now own that money just as much as you do; even if there is a prenuptial agreement, they will likely take that property at your death or if you get divorced; a judge is likely to say that you made them a gift of that property and you can’t ‘take it back’.
Guardianship
The fifth document is a Pre-Need Guardianship Designation. If you become unable to care for yourself, and a court case is brought to protect you, you can name the person who would be responsible for looking after you. If you do not choose a guardian ahead of time, the court would appoint someone.

Criminal Law

Criminal Defense
I handle primarily estate planning and probate cases, and some real estate and business matters. Nonetheless, occasionally I will get a phone call from an existing or past client to the effect that the police want to talk to the client; or that the police have asked the client to ‘come down to the station’ so they can interview them. This is a red flag; the client is probably a suspect in a criminal investigation at this point. My advice to the client is “do not talk to the police, do not cooperate with the police, if the police ask to search something, tell them no, if the police ask you to show them something, refuse, and you need to talk to a criminal attorney” at which point I will usually give the client the name and phone number of several attorneys who handle criminal matters.
DUI/DWI
As I’ve noted elsewhere, limited liability entities, including Corporations, Limited Liability Partnerships and Limited Liability Corporations may not provide as much protection as people think. While all of these entities theoretically provide individual protection from corporate acts for individuals owning an interest in the corporation or partnership, in many cases that protection can be illusory, particularly for small companies where the owner or owners are involved in the day to day operation of the business. Specifically, if you are involved in the day to day running of any business, and some operation of the business winds up hurting someone, chances are that you, individually, will wind up being sued. The classic example is that of a truck that is owned by a corporation, being driven by one of the owners of the corporation, which gets into an accident and winds up killing someone. Notwithstanding that the truck was owned by the corporation, the driver is going to get sued as well; and in this case the driver was one of the owners of the corporation. Likewise, if the truck was being driven by an employee of the corporation, but someone who was not an owner, and it turns out that the driver had a bad driving record, or had previous DUI’s, then whoever hired the employee is likely to be sued and, frankly, if that person was the owner of the corporation, you are going to be sued. In other words, although a corporation, an LLC, or a Limited Partnership can shield you from corporate acts, to some extent, it can’t shield you from your own acts or omissions. And most small businesses have their owners managing and running or overseeing the day to day operations of the business.
Sex Crimes
The police go and talk to the other person, the client, about this; they’ll mention that so and so said that they had sex with the client, and that it was forced or they were too drunk to know what they were doing or they said no, essentially that it was rape. At that point the client should shut up. Period. They should tell the police that they are not talking to the police, and they are calling a lawyer right now, and they need to call a lawyer right then and there. Under no circumstances should they try to “tell their side of the story”.
Misdemeanors
Florida does, however, prohibit gun purchases by anyone who was either adjudicated delinquent or had adjudication withheld for a felony as a juvenile until that person reaches 24; and bars the purchase of firearms by anyone who had adjudication withheld for any felony or a misdemeanor crime of domestic violence and three years has not yet lapsed since the completion of sentencing provisions
Assault

Lastly, if the police come to your door and ask to come in, you should refuse. If they have a warrant they are going to come in; and under some other circumstances they may come in anyway; but you should still politely, non violently, object to their entry and tell them they do not have your permission. And you should shut up at that point. And call a lawyer. Do not invite them in; and if they come in, do not talk to them; To be blunt, today’s news articles dealing with Ibragim Todashev, the martial arts expert shot by the FBI in Orlando yesterday, had the FBI and Massachusetts investigators in his house for two hours, and under questioning by them admitted to taking part in three murders; at which point Todashev attacked an FBI agent and was shot by the agent in self defense, illustrates this point. I have no sympathy for Todashev, he admitted to a triple murder and then tried to attack an FBI agent, nonetheless, from a lawyers perspective, Todashev did not have to allow the FBI agents in his house, and he did not have to talk to the police at all. From a legal perspective, Todashev would have been better off refusing them entry, refusing to talk to them, and calling a lawyer then and there. And he would have been within his rights doing so. Instead, he spent two hours talking to them and wound up confessing to a triple murder. Obviously, this is an extraordinarily serious case, but it illustrates the problem with talking to the police; at some point you may wind up confessing to something even if you didn’t intend to when the conversation started.
Restraining Order
If you are purchasing a firearm from a licensed dealer, you will have to undergo a telephone background check by the Florida Department of Law Enforcement; they will check their records to verify that you are not prohibited from owning a gun; the cost of this check is $5 and is usually passed along to the buyer in addition to the cost of the gun itself. If, for some reason, you are prohibited from owning a gun, please understand that this background check will almost certainly pick up on that, and you may be subject to criminal prosecution for attempting to buy a firearm. Typically the FDLE will contact law enforcement directly and the next person you see will be a police officer coming to arrest you at the store. If you are, for instance, a convicted felon or have a domestic violence conviction or are subject to a restraining order, if you attempt to buy a gun you are very likely to go jail for this, and to go to jail very quickly. Also, please understand that you must be the actual purchaser of the firearm; you can’t buy a gun for someone else who is not able to buy a gun and turn the gun over to that person. That is a criminal offense and a very serious one.
