Spousal Support
You cannot file a Chapter 7 case; however, you can file a Chapter 13. A Chapter 13 will stop collection activity by all creditors (including the IRS, Oregon Department of Revenue, and Support Enforcement for past due child and spousal support) and prevent creditors from foreclosing, repossessing, garnishing or attaching your assets. Although you will not receive a discharge of your debts, you will have up to five (5) years to repay your creditors.

Chapter 7 is also called "straight bankruptcy" or "liquidation bankruptcy." An individual, family or business that is financially struggling, is eligible to file a Chapter 7. Credit cards, medical bills, deficiency balances on repossessed cars are examples of debts discharged in a chapter 7 personal bankruptcy. In some instances back taxes are dischargeable in a Chapter 7 bankruptcy. A Chapter 7 bankruptcy takes about 90 days from start to finish. It is important to remember that some debts are not dischargeable including child support, some taxes, student loans, traffic tickets, restitution and court fines. Protect co-signers on debt. When someone co-signs a loan and the loan is discharged in a bankruptcy, the cosigner may still have to repay all or part of the debt. A Chapter 13 bankruptcy filing offers some protection for co-signers on consumer debt; however, it does not protect co-signers on business debt.
