Wrongful Death
A wrongful death claim was filed with the Pike County Court of Common Pleas against Ford Motor Co. – the manufacturer of the pick-up truck. Homicide
On October 9, 2013, defendant Francis T. Roscioli, Jr. waived his preliminary hearing in Easton regarding multiple criminal charges, including homicide by vehicle. According to The Morning Call, court papers allege that the driver was drunk when he struck and killed a pedestrian walking along Lehigh Drive in Easton PA. The Northampton County District Attorney’s Office is prosecuting the case.
Forgery
Donegal appealed and the PA Superior Court overruled the Trial Court. Once the insurance company received a PA underinsured motorist coverage rejection form bearing both signatures, the burden of proof shifted to the wife. She had to prove that not only was her signature a forgery, but that her husband placed it there without her knowledge and consent. Since she did not present evidence proving that she did not willingly waive underinsured motorist coverage, her UIM claim was denied.
Manslaughter
On June 17, 2011, a Lehigh County driver was charged with involuntary manslaughter, driving under the influence of a controlled substance and other crimes. Investigators recently concluded their analysis of the evidence from a fatal pedestrian-car accident which took place on Nov. 5, 2010 on Race Street in Catasauqua. An article in The Morning Call quotes a police arrest warrant as stating that an accident reconstruction expert determined that a sober driver would have been able to avoid the PA pedestrian accident victim.
Hit and Run
