Adoption

Wrongful Death
The firm brought suit for wrongful death against Cumberland Farms, arising from the tragic death of a wife and mother who was struck down in the doorway of a Cumberland Farms store in November, 2010. The case is the firm's third against Cumberland Farms for death or catastrophic injury resulting from failure to protect pedestrian customers from vehicular traffic with the use of barriers between the pedestrian walkways in front of the stores and the nose-in parking spaces.

Corporate Law
Business disputes range over many fields and topics: insurance, indemnity, partnership, corporate governance, intellectual property, anti-trust, and unfair trade practices. Paul and John have wide experience representing different kinds of business in all manner of disputes.
Business Disputes
Paul became a certified mediator in 2008 and has acted as an arbitrator and mediator in numerous cases involving property damage, business disputes, and personal injury claims.
Intellectual Property

Employment Discrimination
The firm defended employers accused of employment discrimination. In one case, the firm assisted a prominent local business in resolving a difficult claim; in another, the firm appealed a finding of discrimination to the full commission level of the Massachusetts Commission Against Discrimination.
Employment Contract
The employment agreement provided that the plaintiff would receive a salary increase of $17,000, as well as stock options for 33,000 shares of Millivision. The stock options were intended to compensate former employees of Millivision LLC for the wages owed them.

Premises Liability
•On behalf of several insurance company clients, the firm maintains an active insurance defense practice, defending policyholders from third-party claims in a variety of contexts, including premises liability, slip and falls, and dog bites.
Construction Litigation
Weinberg & Garber, located in Northampton, Massachusetts, focuses on litigation and trial work with a specialty in complex litigation. Property Damage
For over 25 years, Paul has handled a variety of property damage claims, representing both first-party claimants and insurance companies on coverage issues, while also providing third-party defense of such claims. In many cases, Paul defended contractors and architects under general and professional liability policies. Paul has developed a reputation as one of the preeminent insurance coverage specialists in Massachusetts.
Condominium Law
The plaintiffs had sought a preliminary injunction, claiming that the construction and repairs being done interfered with their right to quiet enjoyment and amounted to an impermissible “condominium conversion” under Chapter 257 of the Acts of 1983.

Personal Injury
Both recent and older precedent in Massachusetts indicates that claims for trespass, wrongful eviction, wrongful entry, and interference with quiet enjoyment are potentially covered claims under this “personal injury” provision. See, Dilbert v. Hanover, 63 Mass. App Ct. (2005); Titan Holdings Syndicate, Inc. v. City of Keene, New Hampshire, 898 F.2d 265 (1st Cir. 1990).
Medical Malpractice
In addition to the defibrillator cases, Weinberg and Garber expect to handle a good deal of work in insurance and medical malpractice. Several clients they represented while at Robinson Donovan will stay with them in their new venture – it is commonplace in law that clients follow the attorney, not the firm – and they have seen several new referrals.

The firm represents policyholders for a group of small to mid-sized insurers. The firm defends a variety of such cases, including standard tort claims such as slip and falls and dog bites.

Estate Planning
In the meantime, all lawyers — especially trust and estate probate lawyers — should respond to news that the client passed away as a result of a cardiac arrest, by asking “where?” If the client was in an office building, a mall, a health club, a stadium, at a sports event, at a play or movie, at an amusement park, in a plane or on a train, or any similar place, the next question should be “was there an AED?”
Power of Attorney
•A dying woman's gift of her house to her niece triggered intensive litigation and two separate lawsuits, in which the firm represented the recipient of the house. The gift was part of a division of assets between the woman and her long-time companion. The circumstances of the gift included her power of attorney for the companion, her approaching death, and the companion's lack of competence. The firm was brought into the case about a year into the lawsuit. Legal analysis depended on the interplay among the laws of agency, gift, power of attorney, competency, and real estate. After intensive motion practice and the filing of a third-party claim by the firm, the matter was resolved through negotiation.
