Mr. Trushin has handled complex litigation cases before state and federal courts and arbitrators. He has litigated a wide variety of complex commercial claims in such areas as fraud and conspiracy, civil theft, Florida Deceptive and Unfair Trade Practices Act, securities registration and Florida Blue Sky Laws, commercial leases and corporate governance. For over two decades, Mr. Trushin has both obtained injunctive relief on behalf of employers, including emergency relief for breaches of non- compete and non-solicitation agreements, and he has successfully defended such claims on behalf of doctors, lawyers and business professionals. Furthermore, Mr. Trushin has litigated securities cases, including but not limited to, shareholder derivative actions, corporate control contests and partnership and shareholder disputes. He has represented both non-resident domestic corporations and foreign corporations in complex business litigation matters in state and federal courts. Mr. Nicoll ultimately received a certificate in intellectual property law upon graduating from law school, and, following his 1L year, Mr. Nicoll spent a summer abroad studying business law in Paris and Montpellier, France, including courses in business torts and franchise regulation. Non-compete Agreement
Non-compete agreements are contractual terms wherein (a) an employee, (b) franchisee, or (c) person selling a business agrees not to work for a competitor and/or do business in a particular industry within a specified area for a specified amount of time after (a) leaving a job, (b) discontinuing operations of a franchise, or (c) selling the business. Florida courts will enforce these agreements if the terms are deemed “reasonable.” Sometimes Florida courts will enforce non-compete agreements when the specific terms of the agreement are overbroad or unreasonable but the actions of the competing person are particularly egregious, in which case the court essentially re-writes the terms of the agreement and enforce the new, narrower terms. Medicaid Planning
We offer Medicaid planning services to help client’s defer the high costs of long-term care. While Medicare will help pay up to 100 days of skilled or rehabilitative care under certain circumstances, it does not cover any of the costs of long-term care. Long-term care (sometimes referred to as custodial care) services are necessary when someone is unable to perform the basic activities of daily living without major assistance. Those activities including, walking, standing, dressing, feeding, bathing and doing toiletry.

Wills
When a person domiciled in Florida passes away with assets in their individual name and with no designated beneficiary, an estate needs to be open to manage the decedent’s affairs. This court process is called a probate administration. Probate involves identifying and marshaling the assets of the decedent, notifying the decedent’s beneficiaries and creditors of the decedent’s death, paying the decedent’s debts and expenses of administration, and ultimately distributing assets to the proper persons. Who inherits from the decedent depends on whether the decedent was survived by a spouse and/or minor child, and whether the decedent executed a valid last will and testament devising his assets. When the decedent does not have a last will and testament, they are said to have died intestate (meaning without a will) and their assets are distributed to the survivors as outlined in the Florida Statutes. It is a common misconception that the decedent’s assets will escheat (i.e., pass) to the state of Florida. However, the assets of a decedent will escheat to the state of Florida only when the decedent passes away with no last will and testament and no family members can inherit under Florida Statutes.
Trusts
Trusts are popular not only because they can be made as flexible or as rigid as you like, but also because there are different types of trusts you can establish. A trust created during the life of the settlor can be either “revocable” or “irrevocable.” Revocable trusts grant you the ability to maintain control of the assets in the trust, allowing you to change the terms of the trust or revoke the trust at any time. For instance, if you decide your nephew only gets his trust money if he goes to college, that is a condition you can later add to your revocable trust. However, with irrevocable trusts, it is often significantly more difficult to revise the terms of the trust, and may require the consent of the beneficiaries, the court, or a trust protector.
Power of Attorney
At the incapacity hearing, the petitioner has the burden of proving incapacity, and both the petitioner and the AIP can call witnesses, provide evidence, and testify themselves. The court may only adjudicate the person incapacitated if it finds by clear and convincing evidence that the person is incapacitated and there is no other alternative to appointing a guardian. The court may decide that the person is fully incapacitated (i.e., a plenary guardianship), or may limit the adjudication of incapacity and only remove some of the AIP’s rights. Additionally, only some rights removed from the Ward are delegable. For example, the court cannot give the guardian the authority to vote on behalf of the Ward. The court may not appoint a guardian if there is a less restrictive alternative means to entering a guardianship. For example, if the alleged incapacitated person has already granted someone power of attorney, or certain control over their finances, healthcare, or legal affairs, the court may find that this person’s control is sufficient to assist the AIP and provides a less restrictive alternative to imposing a guardianship. Although often necessary, appointing a guardian is extremely intrusive into the Ward’s life, as it results in the taking away of the Ward’s rights and can pose an additional financial burden on the Ward because the guardian is entitled to reasonable compensation from the assets of the Ward.
