As a domestic violence prosecutor for the City and County of Honolulu, he advocated on behalf of victims of child abuse, romantic partner abuse, and murder. Rafael’s goal is to give a voice to the voiceless, which led to his working within the court system to improve the treatment of victims in the criminal justice system.
Mr. Leavitt came to Hawaii in 1968 as a U.S. Marine Corps captain assigned to the Judge Adjutant General’s office at Pearl Harbor. After completing his service in 1970, he joined Hawaii’s fledgling Public Defenders Office. Established that year to safeguard the individual rights of those accused of crimes, the office grew to become the largest criminal defense organization in the State of Hawaii.
DUI/DWI
Impaired driving involves both drunk driving and drugged driving. Because truckers are subject to testing and may lose their commercial license, drunk driving accidents among truck drivers are relatively rare compared to drunk driving among passenger vehicle drivers.
Wrongful Death
Nicole is committed to helping the people of Hawaii and has successfully handled serious injury and wrongful death cases, including motor vehicle collisions, pedestrian collisions, bicycle collisions, slip/trip and fall incidents, serious dog bite incidents, product defect cases and medical negligence.
Traffic Violations
Most motorcycle accidents are caused by motorists who choose to not pay attention to the roadway and then drive into the path of the motorcyclist or moped rider. These same motorists often report that they “didn’t see the motorcyclist” or that the motorcyclist “must have been speeding” because they didn’t see them.
Sex Crimes
At Leavitt, Yamane & Soldner, we understand the devastating impact of sexual assault and abuse and are committed to fighting for the rights of survivors. Unfortunately, statistics show that a significant number of individuals in the United States have experienced sexual assault, with 1 in 3 women and 1 in 4 men affected in their lifetime. Many incidents go unreported for a long period of time due to intimidation or guilt imposed by perpetrators. This can make it impossible for the perpetrator to be criminally prosecuted.
Drug Crimes
After earning her Juris Doctor degree from Gonzaga University School of Law and completing her final semester as an extern for U.S. District Court Judge Leslie E. Kobayashi in Honolulu, Nicole began her legal career as a deputy prosecutor in Honolulu. For five years, she fought for the rights of domestic violence victims and gained considerable trial experience prosecuting a range of crimes, including traffic and drug offenses, financial crimes, domestic violence, and violent crimes. Nicole left the prosecutor’s office as the team captain of the domestic violence felony division to join Leavitt, Yamane & Soldner in 2016.
