Estate Planning
Your Will sets forth your plan for distribution of your property, may name a guardian to care for your minor children and otherwise expresses your wishes upon your death. If you die without a Will (or one of the other estate planning tools referenced above) and a probate is required, the Court will distribute your estate in accordance with state law and make decisions regarding the placement of your minor children – decisions that might not reflect your desires.
Wills
If your loved one dies owning assets which did not pass through one of the many available estate planning tools, a probate may be necessary to transfer ownership to the heirs. During the probate process, the Court will appoint a Personal Representative to administer the estate. The Personal Representative will be required to locate, preserve and protect all assets and to identify and notify all creditors. If the deceased left a Last Will & Testament, the assets will be distributed in accordance with the provisions of the Will. Our attorneys are experienced in handling probates and disputes which may arise within a probate.
Trusts
A revocable Trust offers many advantages. A revocable Trust allows your family to avoid the monetary and emotional burden of a probate following your passing. Unlike a probate which can take 6 months or longer and require a number of court appearances, a Trust allows your named Trustee to distribute your property in a matter of days. If your plan includes distributions to minors or adult children who need guidance and protection, the Trust can delay distributions for decades and place control of the money in the hands of a trusted advisor or financial institution. If any of your beneficiaries are disabled, the Trust can create a Special Needs Trust for their benefit while maintaining their right to government assistance.
Power of Attorney
Your Advance Directive will set the parameters for medical intervention should you become incapacitated. This assures that when you are most vulnerable, your wishes regarding your medical treatment will be honored. A Durable Health Care Power of Attorney allows you to name your spouse, child or other person to act on your behalf in making important decisions during your incapacity.
