Assault
My step-son's mother and her boyfriend were recently arrested for Domestic violence. The charges were dropped against her, but this was her third arrest for domestic violence. My husband obtained an ex parte order for custody and they go to court next week. During the last week of her parenting time, when the assault occurred, the biological mom left her son with the abusive boyfriend for the majority of the week, after the assault had taken place. Not sure how the arrest will effect the custody situation, seeing that she had the charges dismissed (the boyfriend took all the blame). Isn't it equally ''bad'' that she left her son in the care of her abuser while she was available to exercise her parenting time? And how do you think a judge will respond to this situation. Like I said, this is her third arrest for domestic violence, 1st one was when she was 17, the 2nd was against my husband, and now this one. She was convicted on the first offense, plead down to disturbing the peace on the second and now the charges have been dropped on the third, even though there was physical evidence that she was the one doing the hitting. Her boyfriend said that it was self defense on her part because he knew that this would affect the custody situation. Any advice?
Restraining Order
I have a 80 year old man that walks the streets in my neighborhood. 6 months ago he thinks I almost hit his leg with my can tuning the corner on my way home from work. He said nothing to be for months about it. If I did I am not aware of it. For the last 6 months he has been walking around my house over and over when he sees my car in the driveway yelling at my children and wife. I drop my son at the bus stop at 8:45 each morning. He times it so that he goes for his walk at that exact time. I called the police and filed a report. He admitted to the police officer he is doing it to bug me. He stays in the public road careful not to step on my property. I try to look the other way when he walks by me each morning but after 6 months I have had it. Help what to do and not to do.If I did come close to him I am not aware of it. however what he is doing trying to bug me and my family every day by repeatedly walking by my house every day at the same time on my way to work to me is odd behavior and needs to stop. also,at 8:45 this is where the elementary bus stop is and picks up children at that time, I am trying not to confront him in front of the children. I need a restraining order to stick if I file one. What would you do?

Eminent Domain
I live in a private, lake association. There is no paperwork to support the drive as a road, only use of it as such for approximately 25 years. The drive did not exist when I purchased the property, or for 8 years afterward. I would like to close the drive, since it is a safety and privacy issue. The Association Board claims the right of Eminent Domain. Can they legally deprive me of 2500 square feet of my property when driveways exist for the other residents? I gave a personal injury case to an attorney him fully knowing that I was expecting a percentage of the settlement. The case took two years to settle and when I went to his office to collect what I thought was my check, he told me that It was illegal for him to give me anything. He said he thought all along that I was an attorney. I never told him that I was an attorney and over the two year period he never asked me if I was an attorney. I kept calling and made at lease a dozen calls to his office and talked to both him and his associates. He even told me on one occasion that he was looking forward to giving me a big check. As mentioned I followed up with both his office and the client as to the progress of the case looking for a payday. The case was settled a few weeks ago for Three Hundred and Fifty Thousand Dollars and he now after two years tells me that it is illegal for him to give me any money.
Social Security Disability

The purchase agreement arbitration clause was misunderstood by buyers attorney and I was sued. A default judgment was awarded because a serious health issue prevented me from responding. My income is social security disability and exempt from garnishment.I entered a motion and the judgment was stayed. The judge explained the meaning of arbitration and ordered the case to be abribtrated.The complaint contained a figure of $2,300. The default judgment was sum certain in the amount of $22,000.Judge was suspect of the true object of the lawsuit.My former husband was a co-seller but was not included in the lawsuit.He has supplied the buyer with my social security number without my consent.A disclosure statement signed by both sellers was signed and all known problems were stated. Structural damage was noted and the property was inspected four times by purchasers' chosen inspector.Property was bought ''AS IS''.The purchaser knows I have no assets to attach and my income is exempt.Would this be viewed as harassment and frivolous?Is it unlawful for my ex husband to give my soc # without my consent?
