We see too many instances of people who delay executing these documents until it is too late. Once a person is not competent or is unconscious it is too late. This is especially unfortunate if the family needs to access funds for the care of the elderly individual. The only alternative is a guardianship proceeding which is a long and expensive process.

He belongs to the Entertainment Arts and Sports Law Section of the Florida Bar, where he was on the Executive Council and Chairman of the Publishing Committee. He is also a past member of the Media Law Committee of the Florida Bar, and presently is a member of the Intellectual Property Law Section of the New York Bar Association.
Unfair Competition
Mr. Beale also has represented over 30 nurse registries and nursing services in the State of Florida. Mr. Beale has also represented national magazine and book publishers, and film and video producers, and has negotiated and drafted contracts for clients that cover every conceivable area of need, including copyright, trademark, rights acquisition, licensing, publishing, distribution, printing, mergers, and assets and stock purchase and sale agreements. He also has extensive litigation experience in state and federal courts all over the country in all related areas, which include infringements of all types, libel, and slander, invasion of rights of privacy and publicity, First Amendment issues, unfair competition, as well as enforcement of contract rights in these areas.

Employment Contract
The firm advises on such issues as wage and hour, overtime, hiring and evaluating employees, employment termination, discrimination, and harassment, employment contracts & agreements Title VII, ADEA, ADA, Family Medical Leave Act, confidentiality and non-competition/non-solicitation agreements, and reduction in force issues. In todayâ€™s business environment, companies are recognizing that it is essential for an experienced lawyer to draft and/or review employment policies, procedures and provide training to all supervisory personnel. After extensive consulting with the clientâ€™s Director of Human Resources, or other responsible company representatives, the Firm will seek to determine the problems and issues specific to each client. Mr. Beale will endeavor to ensure that the client is prepared to handle the wide array of employment law issues that may arise.

The Firm has experience and can advise and counsel on non-business matters, including probate, wills, trusts, health surrogates, powers of attorney, living wills, real estate, leases, name changes, debtors and creditors rights.
Trusts
The second area is long-range pre-planning for Medicaid eligibility or for those that want to protect assets from creditors or from probate. The most commonly used vehicle is an irrevocable trust. Assets put in an irrevocable trust are no longer the Grantorâ€™s (Maker) assets and not within the Grantorâ€™s control.
