Child Support
Legitimation refers to the process by which a biological father seeks to establish legal rights to a child who was born out of wedlock. Even if a father’s name is placed on a birth certificate, the father may have no legal right to visit with his child. Thus, Ms. McCarthy routinely represents father who wish to establish their legal rights so that they become active, involved parents. The process involves filing a petition with the court at which time the court may order DNA testing. A mother can also attest to the child being the biological offspring of the father which often makes the process of legitimation easier and less time consuming. Once the court has ordered the child legitimated, the father can request from the court the same visitation and custodial rights as any divorcing father. In addition, the court will likely order the payment of child support.
Child Custody and Visitation
Physical custody can be a more challenging area of divorce if the parties do not agree. If the parties cannot agree, the court will usually appoint a primary physical custodian of the child. This person generally has custody of the child during the school week and every other weekend. The non-custodial parent has visitation rights with the child. This can be a traditional every other weekend schedule, however, often the non-custodial parent will be given weeknight visitation, and/or some extended overnight visitation. It is also not unusual to have more time with the child over the summer or holidays depending on the work schedules and proximity of the parents.

Georgia law affords parties the right to contract in connection with and in contemplation of a marriage. These agreements are known as “pre-nuptial” or “ante-nuptial” agreements. The most common reason they are used is to protect property that one or both parties own prior to a marriage. Without such an agreement, depending on how these pre-marital properties are handled during the marriage, the property could be subject to equitable division. Thus, for those parties who have either been married before, or who are pragmatic in their approach to protecting their existing assets, it can be a useful tool to avoid an expensive divorce litigation process.
Spousal Support
The court considers certain factors in awarding alimony which may include, but are not limited to: the standard of living during the marriage, the duration of marriage, the age and physical/emotional condition of the parties, the financial resources of the parties; the time it may take for parties to acquire sufficient education or training for employment, the contributions that a party may have made toward the child rearing, homemaking, education and career building of the other party and family.
Legal Separation
There is nothing specifically delineated by Georgia law, as a “legal separation”. Rather, if you are no longer engaging in marital relations and request a separation, then one of the parties may apply to the court for an order granting special maintenance. This means that all issues can be resolved between the parties, but the court will not actually grant the divorce.
