Child Support
Under Florida law, both parents are required to support their child(ren) financially. In Florida, the amount of child support is affected by the number of children, child-care and health care costs, and the income of the parents. In addition, Florida considers the amount of nights that the child(ren) spend with each parent in determining the payments. Unless the parties equally share expenses, earn the same income, and exercise the same number of overnights with their child(ren), some amount of child support is exchanged between the parties. This could be hundreds, or thousands, and sometimes tens of thousands of dollars per month. Child Custody and Visitation
Child custody is one of the most difficult and heated issues to work out in divorce cases. Florida child custody law has recently changed to eliminate the designations of "primary residential parent" or "secondary residential parent." Instead, courts now require a parenting plan with a time-sharing arrangement that specifies when and how long the child will spend with each parent. Most courts will award equal custody and equal time-sharing to each parent when possible and when it is in the best interests of the child.

Paternity
Fathers of children have both rights and responsibilities when it comes to their child(ren). If a woman is married when she gives birth, Florida law presumes that her spouse is the father of the child (even if he is not). When the mother is unmarried, paternity can be established by both the mother and the purported father by the father signing a “voluntary acknowledgement of paternity.” If there is no acknowledgement, and the woman is unmarried, paternity must be determined by the court. This involves the mother, the purported father, or a representative of the child presenting evidence to the judge as to the biological father of the child. If paternity is established by agreement or through litigation, the father will be responsible for contributing child support, and he can also seek equal time-sharing and decision making power. In the past, wealthy individuals used them to protect their wealth in the event of a divorce. And now, many couples of lesser means are now using the “prenup.” Often these types of marriage contracts include “renewable terms” and/or can expire after a certain date.
Spousal Support
Historically, the payor spouse was entitled to an income tax deduction for alimony payments actually made, and the recipient spouse was required to pay income taxes on alimony payments actually received. However, under the 2018 Tax Cuts and Jobs Act, any agreement between the parties, or judgments entered by the courts as to alimony payments, after December 31, 2018, will not permit the payor spouse to take an income tax deduction for alimony payments actually paid, and the new law will not require the recipient spouse to pay income taxes on the alimony payments actually received.

Parent(s) who have become victims of parental alienation often don't see it happening because the child either can't, or won't, inform the alienated parent as to what the other parent has said, or done.
