Alysia Wightman and Hamp Skelton were successful in obtaining a dismissal with prejudice of all of the plaintiffs' claims in a bad faith suit arising from a house fire in which arson was suspected. The Williamson County district court granted "death penalty" sanctions dismissing the case for discovery abuse and the plaintiffs appealed. In February 2022, the Austin Court of Appeals upheld the judgment for Skelton & Woody's client, finding that the trial court's order met the requirements for the severe sanction of complete dismissal. Restraining Order
Hamp Skelton obtained first a Temporary Restraining Order then a broader temporary injunction against Xerox in September and October 2013 in a case involving breach of a contractual provision barring Xerox from hiring away the employees of the firm's client, Stellargy. The case later settled in a creative manner that restored the working relationship between Xerox and Stellargy. Estate Planning
Defense of major New York venture capital group in lawsuit brought by terminated president and CEO of a company the venture capital group invested in, for fraud and breach of contract in connection with stock option agreement. We were retained shortly before trial to replace a major New York firm. The week before trial, we obtained a complete summary judgment for our client based on statute of frauds, lack of consideration and other affirmative defenses. We then handled the appeal. The Houston Court of Appeals affirmed in 1996 and the Texas Supreme Court rejected opposing counsel's last appeal in late 1997. (The opinion is available on Westlaw at 1996 WL 417651 (Tex. App.--Houston). Drawing upon our insurance coverage law expertise, we also convinced a co-defendant's commercial liability carrier to pay the majority of our legal fees. Estate Litigation

Bankruptcy
Hamp Skelton and Eddie Kaye successfully challenged the dischargeability of a debt in bankruptcy court in an adversary proceeding tried in Austin. Former firm employee, Will Rhodes, was the victim of an assault that left him with a deep gash to the face requiring 34 stitches, only to have his attacker stop a civil proceeding for damages by filing for Chapter 7 bankruptcy in an attempt to avoid financial responsibility for the injuries. Representing Mr. Rhodes, we asserted the doctrine that debts arising from willful and intentional injuries may not be discharged in bankruptcy. United States Bankruptcy Judge Craig Gargotta held a trial on the merits under Section 523 of the Bankruptcy Code in September 2012 on the sole issue of whether the injury suffered was "willful and malicious." Four witnesses testified and the Court issued its opinion on October 26, 2012, finding that the attacker's version of the facts was "not credible" and that the injury was both intentional and malicious. A copy of the Court's opinion -- an interesting read -- is attached here.
Foreclosure
Skelton & Woody PLLC has extensive experience in disputes between lenders and borrowers, in sorting out loan defaults and planning a strategy to maximize lender recoveries. We have represented national banks, regional banks, state banks and loan servicers, as well as individual lenders, and borrowers in matters involving real estate secured loans, personal property secured loans, letters of credit, guaranties, assignments of leases and rents, and subordinaiton agreements. We handle foreclosure and debt collection, as well as work-outs and negotiations with borrowers, correspondent banks and guarantors. Our experience includes all manner of lender liability litigation, breach of fiduciary duty claims, usury claims, matters arising under the National Bank Act, foreclosure issues, injunction actions involving real estate and other bank collateral, offset issues, assignments of rents, limited guaranties, receiverships, and cutting-edge financial institution issues.
