My wife Monica Grace is the owner of a company called Tires To You LLC. We have an insurance agent by the name of Chris Baumli that has written every insurance policy for us since we opened shop (except for a small accident insurance known as AFLAC insurance). This includes all of our automobile policies, our general liability insurance, and our garage coverage.

On February 9th 2015 Chris visited my office at approximately 2PM for two reasons. He wanted to discuss changing my auto insurance policy and how that would affect my business. He also wanted to explain in detail why I needed workers compensation insurance and my risks if my company did not have it. He had already quoted me how much the workers compensation insurance would cost via email on or about January 15th, 2014.

When Chris was done telling us that we needed Workers Comp insurance I told him that he was right. We needed to sign up for it and to please let me know how much it would cost to get it started. He then told me he would go back to his office and contact me with the startup cost information.

The next morning he sent me an email asking for my companies' EIN#. Even though I knew he already had this number (I have proof I have sent him this number in emails in the past) I went ahead and sent him back an email right away with the number. After this I didn't hear anything back from him.

On Wednesday evening at approximately 5PM one of our workers was injured on the job. He broke his hand and his arm when a tire blew up near him. This was more than 48 hours after I told Chris Baumli that I needed workers comp insurance. I believe that our business would have been covered if my agent had done his job properly.

Shortly after this incident I had a meeting with another insurance agent and told him the same thing I told Chris (I was interested, how much to get started) He pulled out paperwork and had my workers comp insurance policy in place the very next morning.
