Divorce
A contested divorce is where the two parties are unable to agree on one or more issues regarding the dissolution of their marriage. Typically, contested divorces mean that the divorce will be filed and resolved in court. Contested divorces can take several months to several years to be resolved. Although, you will have a Judge assigned to your case, most divorces eventually are settled without a full-blown divorce trial.
Child Support
In New York, if you and your spouse’s combined income is greater than $136,000, then the Court has the option to apply the child support formula to that greater income. Many judges will apply the child support formula to the income above $136,000. However, there is no common formula or number as to how much child support will be ordered for income in excess of $136,000.
Child Custody and Visitation
It pays to know the law. Here, the law is very clear, the Courts are to supposed to treat both sexes equally in determining the issue of child custody or any other issue involved in a divorce. When determining custody, the Court is to look at several factors, including: (i) who has been the primary caregiver; (ii) the willingness to foster a relationship between the child and the other parent; (iii) the child’s preference; and (iv) the quality of care.
Premarital Agreement
Prenuptial agreements are not just for the rich and famous. In many instances, you may have assets that currently have a great deal of value or in the future will have a great deal of value that you may want to protect. For example, if you are a police office or teacher, your retirement benefits can be protected in a prenuptial agreement.
Spousal Support
Another important inquiry is how much maintenance (alimony) will be awarded. It is likely that maintenance will be awarded where one spouse has a high income and the other spouse has little to no income. However, there is no formula that specifies exactly how much maintenance should be paid.
Legal Separation
This depends on your personal circumstances. The process for a legal separation and a divorce are very similar. Some people want to stay separated for religious reasons. Others want to stay separated and then see if they can repair the marriage. If you stay separated, there are a few differences between being separated and being divorced. The main differences are: (i) if you are separated, you are still legally married, and cannot get re-married; (ii) there are tax differences between being separated and being divorced; (iii) if you are divorced, you can’t remain on your ex-spouse’s health insurance plan.
Annulment
A divorce ends a legal marriage, an annulment treats a marriage as if it never happened. In New York State, there are certain “marriages” that are considered illegal from the onset and automatically qualify for an annulment, for example: (i) incestuous marriages; (ii) bigamous marriage; (iii) married by someone not authorized to do a marriage. There is a second category of “marriages”, that can be annulled, however, the “marriage” is considered legal until the Court grants the annulment. Those second categories of available annulments are: (i) the parties are not of the age of consent; (ii) one of the parties were incapable of consent; (iii) one of the parties was incapable of entering into marriage due to physical inabilities; (iv) the marriage was due to force, duress or fraud; (v) one party has an incurable mental illness for five or more years.
Child Abuse
False allegations of child abuse: Unfortunately, this is one of the most used “sneaky” tactics. One parent will make false allegations of abuse against the other parent.
