Until then, I am left to work around, strategically present my case so that the burden on the plaintiff is not so burdensomely felt. My goal: fix what can be fixed, help what can be helped, make up for what cannot be fixed or helped. I do this for the little guy, the underdog, the one fighting to make sure the bills s/he owes due to someone harming him/her don’t cost him/her his or her apartment or throw him/her out on the street, cause him/her to miss a child support payment or go so deep into debt that there is no coming out. It is a fight involving human lives. It is not about numbers and cost benefit analysis. For the plaintiff, it is about winning justice in a system that only allows the telling of half-truths. For the defendant, it is only about protecting a swollen and deeply weighted bottom line.
Guardianship
As a trial lawyer mainly focused on vulnerable road users for the past 16 years my outlook sometimes, especially when the time changes, gets a bit darker. Recent catastrophic injury and death cases have been weighing on our practice, and part of that is the suffering a family that is unprepared for death (as though anyone is really prepared) takes on. The additional sufferings, sometimes distractions, for good or ill such as probate and dealing with guardianship and other unintended consequences of the deceased’s unplanned death are hard on anyone grieving.

Criminal Defense
Criminal law attorneys often advertise for personal injury law too. Ask, how many times have you filed a civil law suit? How many civil cases have you tried? Why? If an attorney is specialized in criminal law it does not mean they have a clue about civil law. This is significant this difference between an attorney who primarily represents clients in criminal court and those of us who do civil personal injury law. The bodies of law are substantially different. The strategies vary considerably. Knowing how to strategize a case on behalf of your client so that you can get the best settlement or verdict before a jury of their peers is like apples and oranges when considering how to get the best deal for your criminal client or try that case before a jury of the criminally accused peers.
DUI/DWI
Today was the first annual March of Sorrow in Austin, Texas. An idea that was birthed in New Mexico and has found a place in Austin, Texas. Today was a day to remember those lives lost as a result of intoxicated drivers (DWI and DUI). Eric William Snow spoke about the loss of his friend Cody Johnson who was hit from behind by Stephen Gilbert on Riverside drive, November 3, 2012. Attorney Lenore Shefman spoke on behalf of the mother and guardian of Brian Lindquist who has undergone 14 brain surgeries and now suffering debilitating brain seizures following his being hit by Truett Jones who was driving under the influence of methamphetamines and marijuana on October 12, 2012. Representative Bill Callegari is a sponsor of legislation passed through the House waiting on the calendars committee, aimed at preventing young drivers from driving while intoxicated. Austin Police Chief came with a cadre of officers as well as representatives of the Sheriff’s department and Lakeway Police Department to also discuss the impact DWI has on the lives of everyone in our community.
Traffic Violations
If it is a violation of a right-of-way, or a failure to stop at a red light, speeding, inattention of the other driver (driving while distracted), not keeping a safe distance provide the code section for that law and copy that law into your paragraph. For instance, most of these code sections can be found through google, but you can also look directly at this site: http://www.statutes.legis.state.tx.us/Docs/TN/htm/TN.545.htm. Then state, the law “Sec. 545.152. VEHICLE TURNING LEFT. To turn left at an intersection or into an alley or private road or driveway, an operator shall yield the right-of-way to a vehicle that is approaching from the opposite direction and that is in the intersection or in such proximity to the intersection as to be an immediate hazard.” When Mr. Defendant Driver made the left hand turn directly into my lane of oncoming traffic, there was no time, reflexive or deliberate to avoid a collision. Therefore, Mr. Defendant Driver is liable for the resulting injuries.
Misdemeanors
Here is what could happen: Standard first offense (Class B Misdemeanor) could be 72 hours in jail; $3,000 DPS surcharge; 180 days in jail; $2,000 fine but.....and this is where it gets me, IT DEPENDS. It depends on who your attorney is, who your prosecutor is, and who your judge is. It depends because there are variables that slip through the all too slippery cracks of our justice system.
Drug Crimes
In 2005 and 2006 in Northern and Southern California, the DEA under the Bush Administration was swarming medical marijuana dispensaries that were operating quasi-legally (as legally as they could) under California State Law, specifically The Compassionate Use Act, arguably laws written very poorly. The moment the SCOTUS reached a decision in Reich v. Gonzales, 21 USC 801 the doors to the largest chain of dispensaries throughout the State and the largest edibles manufacturer (our clients) were knocked down and every asset seized in what is called a civil forfeiture action. A civil forfeiture action is a legal tool that allows law enforcement officials to seize property that they assert has been involved in certain criminal activity. This seizure of property includes cash direct from bank accounts. Businesses operating under color of State Laws but impermissible under federal law are subject to this action and medical marijuana businesses operating under the Compassionate Use Act of California were surprised when their money disappeared from their operating accounts and they were left with a subpoena and civil citation they could not defend against, U.S. v. $124,000.00. This taking was common and caused additional lawsuits by employees who were not paid for work they had provided for their employer, now sitting in jail on federal drug charges. Class actions ensued against these employers because often the dispensaries had sufficient employees to trigger what amounted to a factory shut down within less than proper notice required by state employment laws. With all operating expenses seized there is often no way to pay payroll and of course no way to pay for necessary services or expenses.
Assault
Also, Dik Van Meerten, 61, struck by a car that jumped the curb outside Wheatsville Co-op on Guadalupe Street. The driver faced charges of manslaughter and intoxication assault.
Murder
Each of these crashes were in densely populated areas, lots of foot traffic nearby, all involving alcohol and all have different charges brought. The charges span from misdemeanor all the way to capital murder. So what gives?
Homicide

Manslaughter

Hit and Run
